BANKRUPTCY SERVICES

In discussing Bankruptcy types, please note that there are two types of consumer bankruptcy chapters available, the first being Chapter 7 bankruptcy and the second being Chapter 13. Both chapters are available to both individuals and small businesses. In Chapter 7, debts are discharged according to the Bankruptcy Rules, which eliminates the need to repay them. There are exceptions to discharge, but in most cases, debts are discharged. In Chapter 13 cases, debts are organized into a repayment plan, usually at a reduced rate based on several factors. Payments are made monthly to the Bankruptcy Trustee, who pays your creditors directly. There are several advantages to filing Chapter 13 cases and also disadvantages. We can guide you through the differences. Our fee for preparation and filing of your case is fixed at $200 for Chapter 7 cases and $250 for Chapter 13 cases.

Our Living Trust package is offered at $600, which includes drafting your-over will and Powers of Attorney for both Healthcare and Financial. If real estate transfers are needed, we charge an additional $100 for Title Trust Transfer Deeds. Additionally, our Special Needs Trusts are available for $450, ensuring individuals with disabilities can maintain their SSI benefits while having their assets securely managed. All trusts come in a personalized Estate Planning binder, keeping your important documents organized and accessible.

SOCIAL SECURITY DISABILITY CLAIMS REPRESENTATION

Filing a claim for disability benefits can be challenging. The process is rigid and extremely time sensitive. It is a fact that about 65% of all claims are denied on the first application filed with SSA.  Many claimants simply file new applications, which can also be denied upon the first filing of the new application. The numbers improve if one files an appeal of the original decision. Roughly 50% of all appeals are granted nationwide. Additionally, the approval rates vary from state-to-state. For instance, only 37% of initial are approved on the first filing, and in Kansas, that approval number jumps to 46%. Next, let us discuss annuities. Annuities are investment vehicles and is a contract between you and an insurance company to provide you with an income during your lifetime. Unlike life insurance, annuities pay you when you live, and insurance pays you when you die. There are three types of annuities, which are fixed, variable and indexed. With fixed annuities you receive a set rate of return annually. This option allows you to budget without the risk. With variable annuities, your rate of return is based upon the performance of trading platforms such as the stock market or stock indexes. While this type of annuity can return much more than a fixed annuity, there may be some downsides. The fees associated with management of this annuity may outweigh possible gains based on stock market performance. These types of annuities can also be paper intensive and complicated. But the allure of gains without direct participation in the stock market is very attractive. One of the most attractive features of this type of annuity is that distributions are tax deferred like 401(k) plans for instance. You only pay tax on the gains when you take distributions. The third type of annuity is the indexed annuity, with rates of return on par with major trading formulas, such as the S&P 500, the Nasdaq 100 and the Euro Stox 50. Again, rates of return can be attractive and may outperform the variable annuities.  Distributions are also tax deferred.
